Varf\u00f6r \u00e4r det viktigt med ett skriftligt anst\u00e4llningsavtal?<br \/>\n<\/strong>F\u00f6r att undvika missf\u00f6rst\u00e5nd och framtida diskussioner med den anst\u00e4llde om vilka villkor som g\u00e4ller f\u00f6r anst\u00e4llningen b\u00f6r det finnas ett skriftligt avtal som undertecknas av b\u00e5da parter innan anst\u00e4llningen p\u00e5b\u00f6rjas. Ett muntligt avtal om anst\u00e4llning \u00e4r visserligen juridiskt giltigt, men utan ett skriftligt dokument kan det vara sv\u00e5rt att bevisa sin r\u00e4tt vid h\u00e4ndelse av en tvist. Det \u00e4r n\u00e4mligen den som h\u00e4vdar att ett avtal har tr\u00e4ffats som m\u00e5ste kunna bevisa det som p\u00e5st\u00e5s.\u00a0 En rekommendation \u00e4r d\u00e4rf\u00f6r att alltid skriva ner det man har avtalat om. Det kan vara bra att k\u00e4nna till att f\u00f6r anst\u00e4llningsavtal g\u00e4ller avtalslagens regler. Det inneb\u00e4r till exempel att osk\u00e4liga avtalsvillkor kan j\u00e4mkas eller anses ogiltiga med st\u00f6d av reglerna i avtalslagen.<\/p>\n<p><strong>2. Vilka \u00e4r de viktigaste best\u00e4mmelserna i ett anst\u00e4llningsavtal?<\/strong><br \/>\nSenast en m\u00e5nad efter det att arbetstagaren har b\u00f6rjat arbeta \u00e4r arbetsgivaren skyldig enligt lagen om anst\u00e4llningsskydd (LAS) att skriftligen informera om de villkor som g\u00e4ller f\u00f6r anst\u00e4llningen, f\u00f6rutsatt att anst\u00e4llningstiden \u00e4r l\u00e4ngre \u00e4n tre veckor. Denna skyldighet brukar ofta uppfyllas genom att man skriver ett anst\u00e4llningsavtal med den anst\u00e4llde. Anst\u00e4llningsavtalet ska bland annat inneh\u00e5lla parternas namn, adress, tilltr\u00e4desdag, arbetsplats, arbetsuppgifter, anst\u00e4llningsform, upps\u00e4gningstid, l\u00f6n och andra l\u00f6nef\u00f6rm\u00e5ner, antal betalda semesterdagar, normal arbetstid samt om det finns n\u00e5got till\u00e4mpligt\u00a0kollektivavtal.<\/p>\n<p><strong>3. Vilka olika anst\u00e4llningsformer finns det att v\u00e4lja p\u00e5?<\/strong><br \/>\nVilka anst\u00e4llningsformer som finns regleras i lagen om anst\u00e4llningsskydd.<br \/>\nDet finns tv\u00e5 typer av anst\u00e4llningsformer; tillsvidareanst\u00e4llning och tidsbegr\u00e4nsad anst\u00e4llning. Tillsvidareanst\u00e4llning \u00e4r detsamma som fast anst\u00e4llning. Anst\u00e4llningen i sig m\u00e5ste vara en tillsvidareanst\u00e4llning eller tidsbegr\u00e4nsad anst\u00e4llning. Timanst\u00e4llning \u00e4r allts\u00e5 inte en anst\u00e4llningsform. Att ha timanst\u00e4llda betyder bara att du betalar de anst\u00e4llda per timme.<\/p>\n<p>Det finns n\u00e5gra olika typer av tidsbegr\u00e4nsade anst\u00e4llningar:<\/p>\n<p>En provanst\u00e4llning f\u00e5r vara i h\u00f6gst sex m\u00e5nader och kan avbrytas av b\u00e5de arbetsgivaren och arbetstagaren f\u00f6re pr\u00f6votidens utg\u00e5ng. En arbetsgivare som vill avbryta en provanst\u00e4llning i f\u00f6rtid m\u00e5ste l\u00e4mna besked om detta minst 2 veckor i f\u00f6rv\u00e4g. En provanst\u00e4llning som inte avslutas \u00f6verg\u00e5r i en tillsvidareanst\u00e4llning.<br \/>\nDu som arbetsgivare beh\u00f6ver inte ha n\u00e5gon s\u00e4rskild anledning f\u00f6r att erbjuda n\u00e5gon en allm\u00e4n visstidsanst\u00e4llning, som till\u00e5ts under h\u00f6gst 24 m\u00e5nader under en fem\u00e5rsperiod.<\/p>\n<p>En annan typ av tidsbegr\u00e4nsad anst\u00e4llning \u00e4r vikariat. N\u00e4r du beh\u00f6ver ers\u00e4tta en person som ska vara ledig eller anst\u00e4lla personal under semestern kan du anst\u00e4lla en vikarie. Det \u00e4r viktigt att l\u00e4gga in en upps\u00e4gningstid i anst\u00e4llningsavtalet. Annars kan vare sig du som arbetsgivare eller den anst\u00e4llde avbryta anst\u00e4llningen f\u00f6re vikariatets utg\u00e5ng. En anst\u00e4lld som haft vikariat hos samma arbetsgivare i sammanlagt mer \u00e4n tv\u00e5 \u00e5r inom en fem\u00e5rsperiod blir automatiskt tillsvidareanst\u00e4lld.
