I b\u00e5da fallen kom AD fram till att v\u00e4rvningsklausulerna var osk\u00e4liga och d\u00e4rmed ogiltiga. AD har d\u00e4rmed antagit en mer restriktiv syn p\u00e5 till\u00e4mpningen av v\u00e4rvningsf\u00f6rbud. Det \u00e4r d\u00e4rf\u00f6r viktigt f\u00f6r arbetsgivare att utforma s\u00e5dana villkor p\u00e5 r\u00e4tt s\u00e4tt, s\u00e4rskilt vad g\u00e4ller bindningstiden. \u00a0<\/strong><\/p>\n<p>S\u00e5 l\u00e4nge en person \u00e4r anst\u00e4lld g\u00e4ller lojalitetsplikt gentemot arbetsgivaren. Arbetsgivare som vill ha ett skydd \u00e4ven efter anst\u00e4llningen m\u00e5ste avtala med den anst\u00e4llde om det. M\u00e5nga f\u00f6retag v\u00e4ljer att f\u00f6rbjuda anst\u00e4llda att bedriva konkurrerande verksamhet efter det att personen har slutat. Eftersom konkurrensf\u00f6rbud inneb\u00e4r att personen inte fullt ut kan utnyttja sin expertis, med risk f\u00f6r inkomstbortfall som f\u00f6ljdkr\u00e4vs det d\u00e4rf\u00f6r kompensation till den anst\u00e4llde f\u00f6r att s\u00e5dana best\u00e4mmelser ska anses giltiga. M\u00e5nga g\u00e5nger \u00e4r arbetsgivaren framf\u00f6rallt intresserad av att beh\u00e5lla sin personal och sina kunder. En mindre ingripande best\u00e4mmelse \u00e4r ett v\u00e4rvningsf\u00f6rbud som inriktar sig p\u00e5 att skydda bolagets personal och kunder fr\u00e5n att bli kontaktade av f\u00f6re detta medarbetare. Eftersomden inte f\u00f6rs\u00e4mrar den anst\u00e4lldes m\u00f6jligheter att f\u00f6rs\u00f6rja sig s\u00e5 kr\u00e4vs normalt sett inte heller n\u00e5gon kompensation.<\/p>\n<p>I de n\u00e4mnda fallen fr\u00e5n AD hade de anst\u00e4llda klausuler som enligt sin ordalydelse innebar att personerna under en tid av 24 m\u00e5nader fr\u00e5n upph\u00f6randet av anst\u00e4llningen f\u00f6rbj\u00f6ds att v\u00e4rva anst\u00e4llda fr\u00e5n arbetsgivaren. B\u00e5de de nya arbetsgivarna och de anst\u00e4llda \u00f6verklagade beslutet till AD som pr\u00f6vade v\u00e4rvningsf\u00f6rbudets sk\u00e4lighet. Vid tidpunkten f\u00f6r ADs pr\u00f6vning hade det g\u00e5tt cirka 6, 15 respektive 18 m\u00e5nader fr\u00e5n att anst\u00e4llningarna hade upph\u00f6rt. Det tyckte AD var f\u00f6r l\u00e5ng tid. AD uttalar att ett bolag normalt kan anpassa sig efter situationen och den nya konkurrenten efter 6 m\u00e5nader. Tidigare har den allm\u00e4nna uppfattningen varit att bindningstiderna kan vara l\u00e4ngre \u00e4n s\u00e5 och det \u00e4r inte ovanligt attbolag har best\u00e4mmelser som str\u00e4cker sig 18 eller 24 m\u00e5nader.<\/p>\n<p><strong>\u00a0<\/strong>ADs nya och restriktiva syn p\u00e5 v\u00e4rvningsf\u00f6rbud inneb\u00e4r att det \u00e4r viktigt hur dessa best\u00e4mmelser utformas i anst\u00e4llningsavtalen s\u00e5 de inte riskerar att bed\u00f6mas som osk\u00e4liga vid en eventuell framtida pr\u00f6vning i domstol. Om en kortare bindningstid (maximalt 6 m\u00e5nader) anv\u00e4nds \u00e4r det st\u00f6rre m\u00f6jlighet att best\u00e4mmelsen uppr\u00e4tth\u00e5lls. Det \u00e4r ocks\u00e5 viktigt att endast de personer som den tidigare anst\u00e4llde har arbetat med och har kunskap om omfattas av f\u00f6rbudet.
